Sources close to the situation tell TMZ, Swagger -- real name Jacob Hager -- was leaving a "Smackdown" taping at Mississippi Coast Coliseum in Biloxi when he was pulled over for speeding.
According to law enforcement, the officer who pulled him over determined Swagger was driving under the influence -- and a search revealed Swagger was in possession of marijuana.
We're told Swagger -- a former WWE World Heavyweight champ -- was taken in by local sheriff's deputies ... and later released on his own recognizance.
He has been charged with DUI, marijuana possession, and speeding -- all misdemeanors.

| As previously reported, Jack Swagger was arrested on Tuesday night for a DUI and marijuana suspension. The DUI was NOT for alcohol. Per WWE's Wellness Policy, just being arrested is enough for WWE to release him if they so desired. The policy lists as follows:
"Any WWE Talent, who is arrested, convicted or who admits to a violation of law relating to use, possession, purchase, sale or distribution of drugs will be in material breach of his/her contract with WWE and subject to immediate dismissal."
In addition, the violation acts identically per the Wellness policy as a positive test for drugs which includes a potential fine, suspension or more. This would be Swagger's first Wellness violation. | |

| Here is a more detailed report about the Wellness stuff:
Two sections in WWE's Wellness Policy contain verbiage that suggests WWE has the option to release or suspend Jack Swagger following his arrest Tuesday night in Mississippi for allegedly driving under the influence and possessing marijuana.
Section 14 of the Wellness Policy, which is titled Discipline for Violation of Law, reads:
"Any WWE Talent, who is arrested, convicted, or who admits to a violation of law relating to use, possession, purchase, sale, or distribution of drugs will be in material breach of his/her contract with WWE and subject to immediate dismissal."
"In addition to the penalties that may be imposed pursuant to his/her contract with WWE, a violation of this Section 14 may also be treated as a positive test for drugs prohibited by this Policy and therefore, subject to the penalties set forth in Section 15 of this Policy."
If WWE opts not to release Swagger from his contract, the arrest would qualify as Strike One. Section 15 reads:
"First Violation: In the event of an initial positive test for substances prohibited by this Policy other than marijuana and alcohol, the WWE Talent shall be suspended for thirty (30) days, fined an amount equal to thirty (30) days's pay deducted from the WWE Talent's downside guarantee on a weekly basis, and WWE will publicly disclose the WWE Talent's name and duration of the suspension and indicating a first violation the Policy."

A new report on Jack Swagger (Jake Hager's) Tuesday arrest is that Hager is required to return to Gulfport, Mississippi to appear in court related to his driving under the influence charge. This is according to local prosecutor Kirk Clark.
The other charges of speeding and misdemeanor marijuana possession only require fines to be paid online or through the mail.
Hager's court date is scheduled for March 12. If convicted, Hager faces fines of $188 for driving 10 MPH over the speed limit, $437 for a "small amount of marijuana," and $1,300 if this is his first DUI offense. According to the prosecutor, the DUI charge carries a mandatory court appearance and he could lose his driver’s license for 90 days.
There is an exception, according to Clark. The court has allowed some defendants "in limited circumstances" to plead guilty to DUI without appearing in court. This requires an attorney to enter a "plea by affidavit" and the defendant signs a notarized "waiver of rights."
Clark says he will pursue the maximum sentence, which is two days in jail, but the sentence could be served via probation, classes, or AA meetings.
The report also notes that WWE's only comment about the arrest is the statement to TMZ on Wednesday: “Mr. Swagger is responsible for his own personal actions.”
This coincides with WWE releasing a YouTube video on Friday of "Mr. Swagger" breaking character as Jake Hager to promote WWE's invitation to political commentator Glenn Beck to appear on Raw.
Caldwell's Analysis: So, based on the two above items, WWE wants people to believe that the "Jack Swagger" character left the arena, hopped in a car, and allegedly drove under the influence with marijuana in his vehicle? Where is the "Vickie Guerrero" authority figure character to render a penalty to Swagger? Classic example of WWE tripping over themselves to deflect responsibility for their "independent contractors," which is exposed when they used a talent's character's name while trying to avoid being linked to the person committing the offense. | |
