In a shocking and extremely rare move, an Academy Award nominee for original song has had its nomination pulled amid accusations of electoral impropriety. Alone Yet Not Alone, the theme song from a little-seen film with the same title, was the headscratcher of nominations morning two weeks ago. Few had heard of it before it secured a coveted place among the top five movie songs of the year. Now it’s out of the race completely as the Academy of Motion Picture Arts and Sciences rules that its composer, a former governor of the music branch and current member of its executive committee, took advantage of his leadership position to improperly lobby fellow members of the branch. In an interview with Entertainment Weekly’s Clark Collis after the nominations, Bruce Broughton acknowledged that he urged the members of his branch to consider the song, but insisted he had done nothing wrong. “What happens is that the music branch of the Academy puts all the songs on a disc and I was concerned that this song would be really easy to overlook. So, yeah, I wrote some people and said, ‘Could you just take a look.’ That was literally the extent of the campaigning. I received in the mail songs from other films that were pressed and recorded CDs. We didn’t do anything like that at all.” The Academy of Motion Picture Arts and Sciences didn’t think his actions were so innocent. In a meeting of its Governors Board on Tuesday night, the panel voted to rescind the Original Song nod for Alone Yet Not Alone — one of the few times in history the Oscars organization has yanked one of its nominations. That means Broughton and lyricist Dennis Spiegel are out of contention — but the body won’t be adding a runner-up. Instead, the category will only have four honorees this year:
• “Happy” from Despicable Me 2 Music and Lyric by Pharrell Williams
• “Let It Go” from Frozen Music and Lyric by Kristen Anderson-Lopez and Robert Lopez
• “The Moon Song” from Her Music by Karen O; Lyric by Karen O and Spike Jonze
• “Ordinary Love” from Mandela: Long Walk to Freedom Music by U2 — (credited as Paul Hewson a.k.a. Bono, Dave Evans a.k.a. The Edge, Adam Clayton and Larry Mullen; Lyric by Paul Hewson)Among those who didn’t make the cut were Taylor Swift’s “Sweeter Than Fiction” (from the film One Chance), Coldplay’s “Atlas” (from The Hunger Games: Catching Fire), Lana Del Rey’s “Young and Beautiful” (from The Great Gatsby), Ed Sheeran’s “I See Fire”(from The Hobbit: The Desolation of Smaug),and two Edie Brickell songs from The Way, Way Back. In a statement announcing the decision, the Academy said the nomination was pulled because Broughton had emailed members of the branch to make them aware of his submission during the nominations voting period. That would seem to be an innocuous action — studios and publicists are in a constant state of trying to get Academy members to consider their projects. The violation came because of Broughton’s status as an officer in the organization. “No matter how well-intentioned the communication, using one’s position as a former governor and current executive committee member to personally promote one’s own Oscar submission creates the appearance of an unfair advantage,” said Cheryl Boone Isaacs, president of the Academy. The Governors Board called it an ethical breach, and although the violation isn’t specified in any of its rules, the group said rescinding the nomination was justified by this section of the Academy’s guidelines: “It is the Academy’s goal to ensure that the Awards competition is conducted in a fair and ethical manner. If any campaign activity is determined by the Board of Governors to work in opposition to that goal, whether or not anticipated by these regulations, the Board of Governors may take any corrective actions or assess any penalties that in its discretion it deems necessary to protect the reputation and integrity of the awards process.” In a statement sent to EW, Broughton characterized this as an unfair action orchestrated by much more powerful and influential rivals: “I’m devastated. I indulged in the simplest grass-roots campaign and it went against me when the song started getting attention. I got taken down by competition that has months of promotion and advertising behind them. I simply asked people to find the song and consider it.” The song is not without its own interesting backstory. The performer, evangelical Christian author and radio host Joni Eareckson Tada, is a quadriplegic, which obviously adds an emotional element to the recording. And Broughton does have past Oscar cred: he has a previous nomination from 1985 for his score to the western Silverado. | |

| 'Alone, Yet Not Alone': The Other Nominees Who Had Their Oscars Revoked

Alone, Yet Not Alone has some company.
The obscure religious drama, which had its Academy Award nomination for Best Original Song revoked over allegations of improper campaigning, is one of the few films in history to suffer such a fate.
In one case, the film actually won the Oscar — and the victory was overturned after the fact and awarded to the runner-up. And in another — the earliest in the organization history — no one is sure why the film was rejected from consideration.

(2011) LIVE-ACTION SHORT FILM: Tuba Atlantic — Hallvar Witzø, director
“After the awards ceremony on February 26, 2012, the Academy was made aware that “Tuba Atlantic” had been shown on Norwegian television in 2010, making the film ineligible for the 84th Awards under the rules governing the category. In July 2012, the nomination was rescinded by the Board of Governors,” an Academy exec explained.
(1992) FOREIGN LANGUAGE FILM: A Place in the World – (Uruguay)
“After nominations were announced, information came to light that showed that this film was wholly produced in Argentina, and had insufficient Uruguayian artistic control. The film was declared ineligible and removed from the final ballot.”
(1972) ORIGINAL SCORE: The Godfather – Nino Rota, composer
The haunting score for the the crime family epic was originally nominated, but ended up not being included among the final contenders after it was learned that Rota had used part of the theme in the 1958 comedy Fortunella. The nomination was not technically revoked, however. The music branch hosted a revote, which included The Godfather score and five other finalists: Ben, Fellini’s Roma, The Life and Times of Judge Roy Bean, The Other, and Sleuth. Rota didn’t make the cut after this second ballot. Rota did get a nomination — and won — for The Godfather II two years later. The Academy does not consider the original nod an “official” nomination, and so did not include it when asked about past bids that were revoked.

“At the 41st Awards ceremony on April 14, 1969, Young Americans was announced as the winner of the Documentary Feature Oscar. On May 7, 1969, the film was declared ineligible after it was revealed that the film had played in October of 1967, therefore ineligible for a 1968 Award. The first runner-up, Journey into Self, was awarded the statuette on May 8, 1969.”

When the Oscars disqualified "Alone Yet Not Alone" as a nominee in the race for Best Original Song last Wednesday, it issued a statement denouncing its composer Bruce Broughton – a former Governor and current member of the music branch's executive committee -- for actions "inconsistent with the Academy's promotional regulations." Broughton had been caught campaigning to other academy members via email, triggering a controversy that continued to build after academy chiefs first addressed the matter.
Therefore the academy chose to issue a much longer statement of explanation over this weekend:
"The Board of Governors’ decision to rescind the Original Song nomination for 'Alone Yet Not Alone,' music by Bruce Broughton, was made thoughtfully and after careful consideration. The Academy takes very seriously anything that undermines the integrity of the Oscars® voting process. The Board regretfully concluded that Mr. Broughton’s actions did precisely that.
"The nominating process for Original Song is intended to be anonymous, with each eligible song listed only by title and the name of the film in which it is used—the idea being to prevent favoritism and promote unbiased voting. It’s been a long-standing policy and practice of the Academy—as well as a requirement of Rule 5.3 of the 86th Academy Awards® Rules—to omit composer and lyricist credits from the DVD of eligible songs that are sent to members of the Music Branch. The Academy wants members to vote for nominees based solely on the achievement of a particular song in a movie, without regard to who may have written it.
"Mr. Broughton sent an email to at least 70 of his fellow Music Branch members—nearly one-third of the branch’s 240 members. When he identified the song as track #57 as one he had composed, and asked voting branch members to listen to it, he took advantage of information that few other potential nominees are privy to. As a former Academy Governor and current member of the Music Branch’s executive committee, Mr. Broughton should have been more cautious about acting in a way that made it appear as if he were taking advantage of his position to exert undue influence. At a minimum, his actions called into question whether the process was "fair and equitable," as the Academy's rules require. The Academy is dedicated to doing everything it can to ensure a level playing field for all potential Oscar contenders—including those who don’t enjoy the access, knowledge, and influence of a long-standing Academy insider." | |
