Company Trying to Trademark 'ECW" DENIED! WWE Wins [Mostlikely]

In a story straight out of the Sims board, PWInsider reports that a limited liability corporation (LLC) based out of New York named “Mocker” registered to trademark “ECW” for wrestling use in March. WWE apparently let the trademark slip, and the registration was assigned to an examiner earlier this week.

Now they're probably going to have to remove everything ECW. Wonderful.

If that happens I'll be really upset.

Not like I like much of ECW but it is just the principle that the WWE's lawyers should have had that shit dealt with before it expired and someone else got to it..

I mean isn't that what they do?

I wonder what there gonna do I guess there gonna call it Extreme Wrestling?.But come on now why would another wrestling company try to get the ECW name for there brand and when people show up there gonna assume its WWE's ECW this makes no sense.

It makes perfect sense for the exact reason you mention. People are going to show up.

They are pretty much guaranteed a return on the investment; hell WWE may have to pay them a pretty penny to buy back the name..

This story right here is one of those don't belive what here type story.Think about this for a moment lets say theres an AD out that says "Come See ECW live at NY @ 9pm featuring all of your favorite ECW stars!!!" but when people show up and find out its not what they thought it was and see a bunch of people they never seen before.I find this story not true at all.

I get what you're saying, but if people show up and it's not what they expected, they're still going to watch since they paid. And if they're impressed, well... there ya go.

The new 'ECW' trademark from Mocker LLC has been refused registration because of likelihood of confusion with WWE's registration of ECW trademarks, noting that the marketplace could be confused because they are providing similar services that existing trademarks owned by WWE already do and can confuse potential customers.

In their refusal letter, they specifically listed ECW One Night Stand, ECW Extremists, and ECW Vixens as WWE trademarks that already use the same letters. The irony there is WWE doesn't currently use any of the terms.

The government cited TNA Wrestling as an example of how the trademark owner can have a similar place in the marketplace but still use a unique trademark, as opposed to one similar to trademarks owned by another entity.

Mocker has six months to respond.
